Potentially defective or design flaw?

I very much like the Bandfile, as it removes material very easily and is convenient to use. Unfortunately however, the 'tensioning arm' assembly is loose. There appears to be too much space between the inner and outer diameters of the tension arm causing the 'contact arm' to have a sizeable amount of play. When using the tool in a tight radius application, the contact arm tends to jump around, making the surface finish of some filing applications not as good as expected. This maybe a defective unit?, or it maybe designed that way? I plan on returning the unit it in person to Milwaukee to hear what they say.
In short, the motor assembly is very robust. The whole working assembly that clamps onto the motor however requires a little more attention to detail.
